Payment Exemption

Who is exempted from making a contribution?

The Environment Quality Act (EQA) does not stipulate payment exemptions. ÉEQ may, however, establish exemptions in its Schedule of ContributionsÉEQ’s Schedule of Contributions enables companies to determine whether they are subject to the Act, understand the breadth of their obligations and determine the amount of their contribution. Developed using a formula based on studies and verifiable data, the Schedule is established according to type of material and quantities generated during a given year and in consideration of environmental criteria. Framed by thoroughly developed rules, each Schedule is presented to companies for consultation before being sent to the government for approval as required by the Act.

Very small companies and organizations are exempt from paying a contribution and ÉEQ has developed two flat fee options for small contributors. View the Fact Sheet for Low-Volume Producers (2013 SoC).

What are the criteria for payment exemption?

Your company or organization may be exempted from paying a contribution if it meets any one of the following criteria:

  • Has put a total weight of 1 tonne or less of designated materials on the market during the reference year.

  • Has $1 M or less in revenues, receipts or sales in Quebec during the reference year.

  • Has a single point of sale and is not supplied by or operated as a franchise, chain, or under a banner. The last criterion also applies to fast food restaurants.

If your company or organization meets one of the above criteria, you are not required to fill out a detailed Company Report. You simply need to confirm your payment exemption on the online reporting system for each Schedule of ContributionsÉEQ’s Schedule of Contributions enables companies to determine whether they are subject to the Act, understand the breadth of their obligations and determine the amount of their contribution. Developed using a formula based on studies and verifiable data, the Schedule is established according to type of material and quantities generated during a given year and in consideration of environmental criteria. Up until and including the 2013 Schedule of ContributionsÉEQ’s Schedule of Contributions enables companies to determine whether they are subject to the Act, understand the breadth of their obligations and determine the amount of their contribution. Developed using a formula based on studies and verifiable data, the Schedule is established according to type of material and quantities generated during a given year and in consideration of environmental criteria. Schedule of Contributions
, when establishing the weight of materials or revenues, receipts or sales in Quebec, the company must also account for sales to companies located outside of Quebec who, as part of their activities, reintroduce the materials in Quebec. For example, if Company A sells products to Company B located outside Québec, Company A remains responsible for accounting and reporting materials once those products are reintroduced to Quebec for retail sale.

, the company need only consider revenues from the sale of products or services in Quebec, which must also include the sales of products reintroduced in Quebec.
