Who is Subject to the Act?

Voluntary Contributors

The owner of a brand, name or distinguishing guise whose address or establishment is outside Quebec may wish to voluntarily contribute to ÉEQ on behalf of its suppliers in Quebec. An agreement must be signed between the company and ÉEQ to confirm approval of voluntary contributor status.

ÉEQ may also decide to establish an agreement with a third party whose address or establishment is in Canada but outside Quebec that, although it does not own a brand, name or distinguishing guise, may be the main distributor of materials in Quebec.

A voluntary contributor may shoulder only the obligations incumbent on the first suppliers in Quebec for printed matter, containers and packaging under the Schedule of ContributionsÉEQ’s Schedule of Contributions enables companies to determine whether they are subject to the Act, understand the breadth of their obligations and determine the amount of their contribution. Developed using a formula based on studies and verifiable data, the Schedule is established according to type of material and quantities generated during a given year and in consideration of environmental criteria. Framed by thoroughly developed rules, each Schedule is presented to companies for consultation before being sent to the government for approval as required by the Act.

. Even so, targeted companies cannot be relieved of their obligation to pay compensation.

Should a voluntary contributor fail to pay the required compensation, those obligations will revert to the first supplier, as indicated the terms and conditions of the agreement between ÉEQ and the brand owner.

Third party | Terms of the agreement

A third party may only be recognized as a voluntary contributor if an agreement with ÉEQ has been concluded. The agreement establishes that the prospective voluntary contributor:

  • Agrees to pay the contribution determined in compliance with the Schedule of Contributions
  • Agrees to produce the required Company Report
  • Agrees to comply with the above points on behalf of all its first suppliers in Quebec
  • Agrees, once ÉEQ recognizes the entity as a voluntary contributor, to be considered as a targeted entity with regard to the compensation plan
Voluntary Contributors to ÉEQ

The following companies have concluded a voluntary contributor agreement with ÉEQ and agree to meet all the conditions indicated above. These companies are responsible for notifying their first suppliers that they plan to shoulder responsibilities relating to designated materials sold and distributed in Quebec for the Schedule of ContributionsÉEQ’s Schedule of Contributions enables companies to determine whether they are subject to the Act, understand the breadth of their obligations and determine the amount of their contribution. Developed using a formula based on studies and verifiable data, the Schedule is established according to type of material and quantities generated during a given year and in consideration of environmental criteria. Framed by thoroughly developed rules, each Schedule is presented to companies for consultation before being sent to the government for approval as required by the Act.
