Who is Subject to the Act?

Targeted Companies

“Targeted companies” generate products and/or services with containers, packaging and printed matter for Quebec’s market and have an address in Quebec. These companies are required to pay a contribution to compensate for municipal curbside recycling services.

Containers and Packaging 

In order to determine which companies are required to pay contributions for containers and packaging, we must first determine whether the product is pre-packaged or packaging is added at the point of retail sale.

Pre-packaged products

In the case of containers and packaging identified by a brand, name or distinguishing guise, a targeted company is either:

  • The owner of the brand, a name or a distinguishing guise, or is the first supplier in Quebec.

  • The first supplier in Quebec if the owner has no address or establishment in Quebec, and is not the manufacturer of the products and their containers and packaging, whether or not he is the importer.

Products with packaging added at the point of retail sale 

In the case of containers and packaging added at the retail point of sale:

  • Under ÉEQ’s Schedule of ContributionsÉEQ’s Schedule of Contributions enables companies to determine whether they are subject to the Act, understand the breadth of their obligations and determine the amount of their contribution. Developed using a formula based on studies and verifiable data, the Schedule is established according to type of material and quantities generated during a given year and in consideration of environmental criteria. Framed by thoroughly developed rules, each Schedule is presented to companies for consultation before being sent to the government for approval as required by the Act.
    Schedule of Contributions
    , a contribution cannot be required from the manufacturer of the containers and packaging or from the company that has added it at the retail point of sale.

  • When the retail point of sale is supplied or operated as a franchise, chain, or under a banner, the targeted entity is:

  1. The franchiser or owner of the chain, banner or group under which the retail point of sale is supplied or operated, if that franchiser or owner has an address or establishment in Quebec. 

  2. The representative in Quebec of the franchiser or owner if the latter does not have an address or establishment in Quebec.

  3. The retailer if the franchiser or owner does not have a representative in Quebec.

Printed Matter

In the case of printed matter, the following companies or organizations may be required to pay a contribution:

  • The owner of the brand, name or distinguishing guise that identifies a material included in the “printed matter” class.

  • If the owner has no address or establishment in Québec, the first supplier in Quebec of the printed matter concerned, whether or not that supplier is the importer.
