Who is Subject to the Act?

Targeted Companies

“Targeted companies” are those who, according to the application rules of the Environment Quality Act (EQA), are required to compensate the net costs of municipal curbside recycling services for materials designated by the government. The 3 classes of materials to which the compensation plan applies are

  • containers and packaging
  • printed matter
  • newspapers

ÉEQ is the non-profit organization that is certified to represent companies and organizations required to compensate for the cost of recycling materials in the “containers and packaging” and “printed matter” classes. A separate organization, RecycleMédias represents companies required to compensate for materials in the “newspapers” class.

Containers and Packaging 

In order to determine which companies are required to pay contributions for containers and packaging, we must first determine whether the product is pre-packaged or packaging is added at the point of retail sale.

Pre-packaged products

In the case of companies that generate containers and packaging identified by a brand, a name or a distinguishing guise (brand owners) or packaging used for the commercialization or marketing of a product or service in Quebec under a brand, a name or a distinguishing guise, the following companies may be required to pay a contribution under ÉEQ Schedule of ContributionsThe Schedule of Contributions is made up of the application rules, which govern (1) obligation terms, (2) the definition of designated materials, (3) parameters for Company Reports, and (4) administrative terms relating to contribution payments. The Schedule of Contributions also includes a contribution table, which allocates the annual amount of compensation due for a given class of materials (e.g. containers and packaging) and its various component materials (e.g. glass, metal, plastic, cardboard, etc.).

:

  • the owner of a brand, a name or a distinguishing guise who has an establishment in Quebec

    or
  • If the owner does not have a domicile or an establishment in Quebec, the first supplier in Quebec, other than the manufacturer of the products, their containers or packaging, whether or not they are the importers.

Products to which packaging is added at the point of retail sale 

In the case of containers and packaging added at the point of retail sale, the payment of a contribution under ÉEQ Schedules of Contribution is not required from the manufacturer of the containers and packaging nor from the business that adds them at the point of retail sale.

When the point of retail sale is supplied or operated as part of a franchise, a chain, under a banner or as part of any other similar affiliation or grouping, the following companies are required to pay a contribution to ÉEQ:

  • The franchiser or owner of the chain, banner or grouping, if it has a domicile or establishment in Quebec, that supplies the point of retail sale or oversees its operations
  • The representative in Quebec if the business mentioned above does not have a domicile or establishment in Quebec
  • The retailer if the business mentioned in point 1 above does not have a representative in Quebec.
Printed Matter

In the case of printed matter, the following may be required to pay a contribution under ÉEQ Schedule of ContributionsThe Schedule of Contributions is made up of the application rules, which govern (1) obligation terms, (2) the definition of designated materials, (3) parameters for Company Reports, and (4) administrative terms relating to contribution payments.   • If the owner does not have a domicile or establishment in Quebec, the first supplier in Quebec of the printed matter, whether or not that business is the importer
